Attorneys Helping People in Uniontown, PA
When you have a serious surgery or a significant illness, you expect pain and discomfort as you get better. However, you do not expect that the care or treatment you receive will make you worse. When that happens because the medical provider was negligent, you will feel more than physical pain. You will feel betrayed, anxious about the future and uncertain about your prognosis. You may wonder if you will ever work again and be able to take care of your family.
Medical mistakes are not the only result of negligence by a doctor, nurse or other provider. Failure to perform certain actions or make decisions correctly—or at all—can also cause injury or additional illness. Administering or prescribing the wrong medication or the wrong dosage can also be disastrous and result in serious complications and even death.
Although the legal system allows patients who suffered because of medical negligence to obtain compensation for their injuries and losses, taking on the hospital or doctor who caused the situation should not be done alone. Hospitals and other medical providers in the Uniontown, Pennsylvania area and throughout the state have batteries of lawyers at their disposal; their job is to try to limit liability and prevent awards and settlements to those who were injured. If you hope to get justice through the legal system after being injured or losing a loved one because of medical negligence, it is critical to have an experienced medical malpractice attorney by your side. An attorney can help you fight for compensation for your losses, injuries and expenses.

How Do I Know if Medical Negligence Caused My Injury?
Although each case is different, some common themes appear in all successful medical malpractice cases. The injured person—the plaintiff—must be able to prove that you had a doctor-patient relationship with the defendant, the doctor, hospital or other medical provider. You cannot sue someone you overheard in the lunch line or an elderly relative who gave you bad advice. You must also prove that the provider was negligent and did not adhere to the accepted standard of care. You cannot file a claim just because you did not like the outcome. Further, you must prove that the negligence caused the injury or worsening illness. Finally, the patient must prove that the injury or illness caused by the negligence resulted in actual damage, damage that can be translated into financial terms. In short, proving medical malpractice is a challenge.
